In recent years, the transfer pricing landscape in the Asia Pacific region has been developing rapidly in order to address both the increasingly diverse and complex economic activities in the region and also in response to broader tax policy developments throughout the world.

Most companies are now familiar with the use and requirements of transfer pricing principles and methods in managing their corporate tax obligations.  However, few are fully aware of the impact of transfer pricing on customs valuation - the basis for assessment of customs duties and inland taxes (e.g. VAT).  In fact, decisions related to transfer pricing policies and methods have far reaching customs implications with regards to duty costs, compliance with customs valuation rules, and even qualification for Free Trade Agreements.

The value of an import transaction that is determined through the application of a company’s transfer pricing policy is not necessarily acceptable under customs valuation rules.  Customs authorities throughout the region are increasingly knowledgeable of this fact and, given their struggle to meet revenue collection targets in a world of ever-decreasing duties and proliferating free trade agreements, are increasingly engaging in customs audits and investigations of declared import value.
